Lindsay Lohan checks into rehab... but not the right one

NEW YORK –  Lindsay Lohan is treading on thin ice. The troubled actress is supposed to check in rehab in New York this morning as per the plea deal her lawyer, Mark Heller, set up with a California judge in March.

But Peter Toumbekis, who works with Heller, told Fox News as of late Wednesday Lohan had yet to check in to the agreed-upon facility: the Seafield Center in Westhampton, N.Y.

“You'd think she'd be there already,” he said. “Tomorrow should be very exciting"

Meanwhile, TMZ and E! News reported that Lohan has decided to ditch the Seafield Center and head for a rehab facility in California. TMZ reported the change in facilities is something prosecutors, and the judge, have not agreed to.

Toumbekis said, to the best of his knowledge, Lohan was still in New York, but he didn’t rule out the possibly that she had jetted to California.

"All I know is she hasn't boarded any commercial flight,” he said.

If Lohan does not turn up at rehab by Thursday morning, Toumbekis suggested the court would issue a warrant for her arrest.

"I guess we'll all find out in the morning together. Either she'll be in rehab, in court, or there will be a warrant. It should be very exciting"

And as of Tuesday, it seemed the “Liz & Dick” actress was planning to check in to rehab as scheduled. She posted a photo on Instagram of herself amid suitcases and clothes.

"90 days and 270 looks," she wrote in the caption.

On Thursday, Heller is expected to appear in California to show the judge proof that she entered the rehab facility. 

Toumbekis said Heller was “in transit” to California on Wednesday. He added that what happens at court on Thursday "is anyone's guess."

Manchin works to get Senate vote on gun checks- California weighs ban on lead bullets for hunting

West Virginia Democratic Sen. Joe Manchin said Sunday he’s not finished with his effort to expand background checks for gun buyers, despite the proposal’s defeat and other key senators appearing to now move beyond the issue.

Manchin told “Fox News Sunday” that he’s going to rework the proposal to get it back to the Senate floor.

“We’re going to work this bill with all of our hearts,” he told Fox News.

Manchin was joined by Pennsylvania Republican Sen. Pat Toomey in crafting the background check proposal, in part to get bipartisan support for the largely Democratic gun-control plan, following a mass shooting in December 2012 in which 20 first-graders were killed.

However, the proposal to expand the check to online sales and gun shows was shelved earlier this month when it got just 54 of the required 60 Senate votes.

On Friday, Toomey said he had no plans to revive the proposal.

"My own view is very simple: The Senate has had its vote. We've seen the outcome of that vote. I am not aware of any reason to believe that if we had the vote again that we'd have a different outcome," he said, according to The Philadelphia Inquirer.

Manchin told Fox: “I don’t think he’s done.”

He also said he has spoken with fellow gun owners who appear to support legislation that would keep firearms out of the hands of criminals and the severe mentally ill.

Manchin said “law-abiding citizens” support background checks, and he urged Americans to read the proposal, then tell him what parts they don’t like.  

Senate Majority Harry Reid said days after the defeat of the Manchin-Toomey proposal that he has “hit pause” on efforts to pass comprehensive gun-control legislation. 

He said last week the proposal remains a work in progress but no action is being taken now.

A top White House official acknowledged Sunday that President Obama knew some of his gun-control initiatives would likely be rejected but defended his efforts and called on Congress to “do the right thing.”

“The president pushed very hard,” White House adviser Dan Pfeiffer said on “Fox News Sunday.” “We knew all of the (proposals) would not pass right away.”

With a proposed ban on semi-automatic weapons and high-capacity gun magazines off the table for now, Obama appears to be focusing his efforts, including the garnering of public support, on getting Congress to agree to universal background checks for gun buyers.

Pfeiffer said the president has “marshaled people to his side” and polls show a large majority of the public supports background checks.

“You cannot get 90 percent of the people to agree on the weather,” Pfeiffer told Fox. “The question is whether Congress is going to do the right thing.”

A final Senate bill was expected to be released this week, when Congress returns from Spring Break. But the voting could be delayed as senators wrangle over the background check issue. The legislation would come about four months after a mass shooting at a Newtown, Conn., elementary school in which 20 first-graders and six adults were killed.

Pfeiffer said the president agrees with the efforts so far of Senate Majority Leader Harry Reid and other senators.

“This is the best response to Newtown and gun violence in the country,” Pfeiffer said.
